We advise our clients strategically on all aspects of labor law in connection with company transactions, reorganization and restructuring, aiming thereby at balanced and commercially viable solutions in collective bargaining, company transfers, redundancy payments and other company transformations. We bring an employer-oriented, commercial approach and practical expertise as well as creativity and negotiating skill to wage negotiations with works councils and trade unions, wage agreements, company agreements and social programs.
We collaborate with you, the client, to develop individualized employment structures within the company, from flexible working arrangements to innovative systems for remuneration and incentivisation including semi-retirement models and the establishment of company pension schemes. We create legally secure employment contracts for managing directors and board members as well as other staff. We advise and support employers as well as senior staff in matters of forced redundancy and consensual severance arrangements.
Our clients can rely on our wide ranging experience in questions of company employee codetermination, changes of collective agreements and hiring out of employees. We also represent employer interests at all stages of labor law litigation as well as in dispute resolution procedures. We also possess highly regarded and acknowledged expertise in the global transfer of staff within multinational group concerns.
The creation of company pension schemes poses a particular challenge to the legal adviser as it requires a balancing and harmonization of labor law considerations with taxation, insurance and accounting elements. Working closely with our cooperating partner Deloitte we offer comprehensive advice including on complex systems such as contractual trust arrangements (CTA) or cross border arrangements. In terms of transaction consultancy we provide legal advice and support on the handling of pension book reserves and indicate e.g. a range of alternative solutions to the direct pension commitments still common in Germany.
We would be delighted to keep you informed on current legal developments through our newsletter "Forum Arbeitsrecht" in German language (Labor Law Forum).
